terms of service
IMPORTANT
The Client will receive a physical, pre-painted figure along with a digital set of professional photos. Source files (e.g. 3D models, raw design files) and other working assets will not be shared or distributed.1. PAYMENTS
a. Client may pay fully upfront, or with a 50% down payment before sculpting and 50% after sculpting phase completion.
b. Invoices, proposal or payment link will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist. The Artist shall not be liable for any failed payments or payments made to unauthorized parties if the Client made such payments through links or payment methods not provided by the Artist through previously verified means of communication. The Client acknowledges they are responsible for verifying the authenticity of payment links and instructions. If the Client receives payment links or instructions from any party claiming to be the Artist, the Client must verify the authenticity of such requests with the Artist before taking any action. The Artist will not be liable for any financial losses incurred by the Client as a result of payments made through unauthorized or fraudulent means.
e. Prices may vary or change depending on complexity, requirements and/or additional requests.
g. Chargebacks will be disputed with proof of services rendered, agreement terms, and the refund policy mentioned below will be followed.2. REVISIONS
a. 3 minor revisions allowed per item shown to the Client during the process.
b. Additional charges for excessive or major revisions may be required.
c. Revisions may affect progress and timeline.3. DEADLINES AND DELIVERY
a. It will take the Artist approximately 45-60 days to finish the sculpting phase of a commission after work has begun. Painting and photography is expected to take an additional 60-75 days to finish. Additional time may be taken for delivery throughout various phases.
b. The Client acknowledges that the inherent risk of damage during shipping exists. The Artist will take reasonable care and effort in packaging the Work for one-off orders or communicating with manufacturing partners about effective packaging of the Work for larger orders to minimize such risks, but the Artist will not be liable for any damages or loss of the Work that occurs during shipping.4. RIGHTS AND USAGE
a. Artist Rights
i. The Artist retains copyright, ownership, redistribution and intellectual property rights to the 3D work, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more. The Artist shall not present or use the Work in a manner that is unlawful or that could be considered harmful or derogatory to the Client.b. Client Rights
i. Clients receive exclusive, non-transferable usage rights to the Work for personal use. The Client shall not present or use the Work in a manner that is unlawful or that could be considered harmful or derogatory to the Artist. Refer to Section 4.c. for commercial rights.
ii. Personal use means: Display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.
iii. Client must not claim Work as their own and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.
iv. Client must not edit or modify Work in any way without prior permission from the Artist.c. Commercial Rights
i. Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. figurine mass production, vtuber models, stream overlays, emotes, and so forth) or as agreed upon.
ii. Commercial rights means usage of Work on streams or any monetized instances, or selling, licensing, or distributing the Work to third parties.
iii. Usage of Work for AI (artificial intelligence) tools; platforms or programs, ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
iv. Additional charges will be required for commercial usage if not included. Rate may vary based on intended usage and distribution scale.5. REFUNDS
a. If a commission is cancelled before sculpting begins, the 50% upfront fee will be refunded, excluding transaction fees.
b. If a commission is cancelled after work has begun, a partial refund may be issued at the Artist’s discretion based on the amount of progress completed. No refunds will be issued after the sculpting phase is completed.6. COMMUNICATION
a. Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
b. Communication channels may include Discord or Twitter private messages.
c. Artist response time may vary, up to two weeks for major updates. However, quick check-ins may happen in between.
